Overview

A New York Times articles has revealed the countries that are being considered for a partial or full suspension on entry to the United States. Anonymous sources speaking on condition of anonymity have revealed that the affected countries have been divided into three tiers: red, orange, and yellow.

Each of these tiers is subject to certain restrictions on entry to the United States.

The “red” tier includes a list of countries whose nationals would be barred from entering the United States for a temporary period of time, that is yet to be determined by the U.S. government.

These countries include:

  • Afghanistan
  • Bhutan
  • Cuba
  • Iran
  • Libya
  • North Korea
  • Somalia
  • Sudan
  • Syria
  • Venezuela and
  • Yemen

The “orange” list of countries includes nationals whose entry would not be barred from the United States, but who must be properly vetted and screened at mandatory in-person visa interviews and U.S. ports of entry before gaining admission to the United States.

These countries include:

  • Belarus
  • Eritrea
  • Haiti
  • Laos
  • Myanmar
  • Pakistan
  • Russia
  • Sierra Leone
  • South Sudan and
  • Turkmenistan

A third and final “yellow” list includes countries have been identified as having security deficiencies which requires their governments to make changes within a period of 60 days. Noncompliant countries may risk being added to either the “red” or “orange” lists above.

The yellow countries include:

  • Angola
  • Antigua and Barbuda
  • Benin
  • Burkina Faso
  • Cambodia
  • Cameroon
  • Cape Verde
  • Chad
  • Republic of Congo
  • Democratic Republic of Congo
  • Dominica
  • Equatorial Guinea
  • Gambia
  • Liberia
  • Malawi
  • Mali
  • Mauritania
  • Kitts and Nevis
  • Lucia
  • Sao Tome and Principe
  • Vanuatu and
  • Zimbabwe

Will visa holders and green card holders from these countries be impacted?

It is not yet known whether the travel ban will cause travel disruptions for existing U.S. visa holders and lawful permanent residents from the affected countries.

If you are a national from any of the above-mentioned countries, it is recommended for you to seek the advice of an immigration attorney as soon as possible.

Moving Forward

Visa holders currently outside of the U.S. should consider returning to avoid being prevented from re-entering the country.

If a travel ban is issued, U.S. Consulates worldwide will stop scheduling visa interviews and issuing visas for nationals in the red tier.

Visa applicants in the orange tier will be subject to additional vetting and scrutiny at consular visa interviews and U.S. ports of entry. This means that applicants must be well-prepared for their visa interviews and further questioning can be expecting when entering the United States.

Please be aware that the official travel ban has not yet been released by the White House. Therefore, the final list of countries subject to the travel ban may be different than the information currently available.
