Adjustment of Status Filing Chart March 2024
For the month of March 2024, the U.S. Citizenship and Immigration Services (USCIS) will use the Dates for Filing chart for family-sponsored filings to determine eligibility for I-485 adjustment of status filings (green card filings inside the US).
For employment-based preference categories, USCIS will use the Final Action Dates chart to determine eligibility for I-485 adjustment of status filings (green card filings inside the US).
What Changes Can Be Seen Next Month?
Employment-based categories
Dates for Filing
- The March Dates for Filing remain the same as February 2024, with the exception of the employment-based fourth preference category, EB-4 which will advance by 4 months to January 1, 2020.
Movement in the Final Action Dates
The Final Action Dates Chart shows some modest advancements in some of the employment-based preference categories, specifically for:
- EB-1 China will advance by two weeks to July 15, 2022
- EB-1 India will advance by 1 month to October 1, 2020
- EB-2 Worldwide, Mexico, and the Philippines will advance by 1 week to November 22, 2022
- EB-3 Worldwide, Mexico, and the Philippines will advance by 1 week to September 8, 2022
- EB-3 Other Workers, Worldwide and Mexico will advance by 1 week to September 8, 2020
- EB-4 will advance by more than 6.5 months to December 1, 2019
Family-sponsored categories
Dates for Filing
- The March Dates for Filing remain the same as February 2024.
Movement in the Final Action Dates
The Final Action Dates Chart for the family-sponsored categories shows major advancements across almost all preference categories as follows:
- F1 Worldwide, China, and India will advance by more than 5 weeks to February 8, 2015
- F2A Worldwide, China, India, and the Philippines will advance by almost 4.5 months to June 22, 2020
- F2A Mexico will advance by almost 4.5 months to June 15, 2020
- F2B Worldwide, China, and India will advance by more than 7 weeks to November 22, 2015
- F3 Worldwide, China, and Mexico will advance by more than 5 months to October 1, 2009
- F4 Worldwide and China will advance by almost 2.5 weeks to June 8, 2007
- F4 India will advance by 1 month to December 15, 2005
- F4 Philippines will advance by 8 months to June 15, 2003
Prediction: The Department of State is still crunching numbers to determine the availability of visa numbers. We believe that we will not see significant movement in the visa categories until later this year, starting in either the late spring or by the summertime. However, it is still important for you to review the Visa Bulletin on a monthly basis to keep track of its progress.

FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE CASES
According to the Department of State’s March 2024 Visa Bulletin, the following Final Action cutoff dates will apply for employment-based categories, and will determine when applicants in the United States can file adjustment of status:
- EB-1 Worldwide, Mexico, and the Philippines will remain current
- EB-1 China will advance by two weeks to July 15, 2022
- EB-1 India will advance by 1 month to October 1, 2020
- EB-2 Worldwide, Mexico, and the Philippines will advance by 1 week to November 22, 2022
- EB-2 China will remain at January 1, 2020
- EB-2 India will remain at March 1, 2012
- EB-3 Worldwide, Mexico, and the Philippines will advance by 1 week to September 8, 2022

Conclusion
In conclusion, the Final Action Date chart for the family-sponsored categories shows major milestones in nearly all preference categories. Additionally, the Final Action Date chart for the employment-based categories shows modest advancement, particularly for EB-1 India and EB-4. The Dates for Filing chart remains unchanged, except for the advancement of the EB-4 category to January 1, 2020.
USCIS will continue to use the Dates for Filing chart for family-sponsored adjustment of status filings, but will use the Final Action Date chart for employment-based adjustment of status filings. Family-sponsored applicants who qualify should submit their filings, while the Dates for Filing chart is still being used by USCIS.
