The visa bulletin is issued every month by the Department of State. It shows which green card applications can move forward, based on when the immigrant petition that starts the green card process was originally filed. The visa bulletin allows you to estimate how long it will take before you will be able to get your green card, based on how quickly the “line” is moving now. You can check the visa bulletin on a monthly basis to determine your place in line.

What’s happening in the employment-based categories?


FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE

According to the Department of State’s March 2022 Visa Bulletin, the following final action cutoff dates will apply for the issuance of an immigrant visa for employment-based categories:

  • EB-1: All countries, including India and China, will remain current.
  • EB-2: India will advance by 4 months to May 1, 2013, and China will remain at March 1, 2019. All other countries will remain current.
  • EB-3 Professionals and Skilled Workers: EB-3 India and China will remain unchanged from the previous month, at January 15, 2012, and March 22, 2018, respectively. All other countries will remain current.
  • EB-5: The Non-Regional Center program will be current for all countries, including China. The Regional Center program has expired and is listed as unavailable in the March 2022 Visa Bulletin. If reauthorized, the Regional Center category will also be current for final action for all countries except China, which would be subject to a November 22, 2015 final action date.

Which filing chart do I use if I want to apply for adjustment of status based on employment within the USA?


All employment-based preference categories, except EB-5 petitions based on the Regional Center Program, may apply for adjustment of status using the Dates for Filing Chart in the Department of State Visa Bulletin for March 2022.


What can be expected moving forward from the employment-based categories?


In this month’s visa bulletin, the most important highlight is that EB-3 China Other Workers advanced by one-month to July 1, 2015, and EB-4 El Salvador, Guatemala, and Honduras retrogressed by almost 2 years.

Additionally, DOS estimates that it may soon be necessary to establish EB-5 Non-Regional Center Final Action and Dates for Filing cutoff dates for China. DOS predicts this may occur as early as April 2022, which would make the category no longer current for China-mainland born nationals.

DOS also predicts that EB-2 India might soon retrogress in the coming weeks.

What are some of our key immigration law predictions for the upcoming year?


Increase in Filing Fees for USCIS petitions and DOS Non-Immigrant Visa Fees


Our first prediction for the new year is an increase in filing fees at both the USCIS and Department of State levels, to help increase government resources during the ongoing COVID-19 pandemic. As you might recall, back in October of 2020, USCIS attempted to increase its filing fees to meet its operational costs. Among the petitions that were to be the most impacted were N-400 applications for naturalization, L visa petitions, O visa petitions, and petitions for qualifying family members of U-1 nonimmigrants.

Fortunately, in September of 2020, a federal court struck down the planned USCIS increase in fees arguing that the new fee increases would adversely impact vulnerable and low-income applicants, especially those seeking humanitarian protections.

We believe that early in the new year USCIS will again publish a rule in the Federal Register seeking to increase its fees to help keep the agency afloat. USCIS previously insisted that the additional fees were necessary to increase the number of personnel at its facilities to meet the increasing demand for adjudication of certain types of petitions. It is no secret that USCIS has experienced severe revenue shortfalls since the start of the pandemic as more and more families found it difficult to afford filing fees. The United States Citizenship and Immigration Services (USCIS) has submitted for federal review, a final regulation that if passed would expand premium processing services to additional categories of immigrants. The rule is currently under review at the Office of Management and Budget (OMB). While the rule has not yet been published in the Federal Register, it has the potential to substantially improve processing times for more categories of immigrants that have been waiting extended periods of time for their applications to be approved during the COVID-19 pandemic.

In this post, we break down exactly who may benefit from this new regulation and what fees might apply once the rule becomes final.

Overview


Many have been eagerly awaiting news regarding the expansion of premium processing services and it seems the time has almost come. For those who may be wondering, premium processing service is a special type of fee-based service offered by USCIS that allows for expedited processing of certain Form I-129, Petitions for Nonimmigrant Worker, and Form I-140, Immigrant Petitions for Alien Worker. With this service, applicants can pay an additional fee and submit Form I-907, Request for Premium Processing Service, to guarantee the adjudication of their applications within 15 calendar days.

The current categories of applicants who can request premium processing service and the required filing fees are as follows:

  • $2,500 if you are filing Form I-129 requesting E-1, E-2, E-3, H-1B, H-3, L (including blanket L-1), O, P, Q, or TN nonimmigrant classification.
  • $1,500 if you are filing Form I-129 requesting H-2B or R nonimmigrant classification.
  • $2,500 if you are filing Form I-140 requesting EB-1, EB-2, or EB-3 immigrant visa classification.

Outside of the above categories of visa applicants, premium processing service has not been made available to other applicants. But this may all be about to change.

While we are still awaiting the rule’s official publication in the Federal Register to study its complete details, we know that the rule will identify additional categories of applicants who can request premium processing service and will provide in detail the processing times, and associated fees for each type of applicant.

What is the difference between having a green card and U.S. Citizenship?

First, let’s discuss the basics. When a person wants to immigrate to the United States permanently, the first step is to apply for a green card (also known as permanent residence). There are various different ways a person can qualify for a green card. The most common avenues to obtain a green card are family sponsorship through a qualifying relative (U.S. Citizen or LPR spouse, child, parent, or sibling) or employment-based sponsorship, where an individual will first obtain a work visa based on a job offer and then become eligible to apply for permanent residence through their employer. There are also other special categories of immigrants such as asylum seekers, Violence Against Women Act (VAWA) victims of domestic violence, diversity visa lottery winners, and many others who also qualify for a green card. There also green card avenues for individuals of exceptional ability (EB-1), those whose employment is in the national interest (EB-2), and EB-5 immigrant investors who invest at least half a million dollars in a new business enterprise or Regional Center project. While there are many ways to obtain a green card, the ultimate goal is to obtain permanent residency.

Once a person has obtained a green card, typically that person must wait a number of years before being eligible to apply for U.S. Citizenship. For instance, those who obtained their green card based on marriage to a U.S. Citizen and continue to remain married, must wait 3 years from the date they became a permanent residence to apply for citizenship. All others must wait 5 years from the date they became a permanent resident to become eligible to apply for U.S. Citizenship.

The Biden administration has released a new bill, the Build Back Better Act, that includes a new immigration framework that if passed would positively benefit employment-based green card applicants. The bill also sets aside $100 billion dollars for immigration purposes to reduce the immigrant visa backlogs and to recapture unused immigrant visas.


New Framework for Immigration Reform


Over the past few months, Congressional Democrats have been working on passing comprehensive immigration reform to modernize the current immigration system and open a pathway to citizenship for young undocumented immigrants known as “Dreamers,” and other groups of individuals including highly skilled immigrants. The Democrats have presented several immigration reform proposals to the Senate Parliamentarian to increase the chances of passing immigration reform without having to receive majority support from the Republican party. Passing reform through a reconciliation bill has been the most effective means of bringing about much needed changes because of opposition for reform in our current immigration climate.

The proposals in this new bill are interestingly much different from other proposals we have seen so far from Democrats. If passed, the bill would prioritize recapturing immigrant visas in family and employment-based categories for immigrant visa numbers that went unused between Fiscal year 1992 and fiscal year 2021. Such a provision would have the potential of adding more than 220,000 employment-based green cards to the current pool of immigrant visas currently available according to researchers. This would be a groundbreaking new policy because it would have the potential to drastically reduce the current visa backlogs, in both the family and employment-based categories. In some family-based categories, applicants must wait over 20 years for their priority date to become current and a visa to become available. Recapturing new visa numbers and putting them back into the system will be very advantageous for those waiting for a visa.

While the final outcome of this proposal is still uncertain, it is a good preview of what is to come and of its potential for approval in the House and the Senate.

What’s the latest news with respect to immigrant visa numbers?

U.S. immigration laws limit the number of immigrants that can be admitted to the United States each year. The annual numerical immigrant visa limits are based on complex formulas and are subdivided among several preference categories and country “caps.” To illustrate, the annual limit for family-sponsored petitions is 480,000, which includes visas for immediate relatives, while 140,000 visas are allocated for employment-based immigrants. Unused family preference visas from the preceding years are added to employment-based visa numbers to maximize number use.

We have learned that employment-based visa numbers for fiscal year 2022 are expected to be 290,000 – an all-time high. As of today, the pending demand experienced by both the State Department and USCIS in the employment third preference category, for applicants born in India and China, will already exceed the amount of numbers that are available to applicants from those countries throughout fiscal year 2022 in the third preference category. In comparison, in fiscal year 2021, only 9,000 employment-based visas in the third preference category went unused. In fiscal year 2022, there may be close to 85,000 unused employment-based immigrant visas.

What is the role of the National Visa Center in your immigration journey?

The National Visa Center is an extremely important agency that acts as a middleman between USCIS and the Consular post or Embassy where your visa interview will eventually be scheduled.

After U.S. Citizenship and Immigration Services (USCIS) approves your immigrant visa petition, USCIS forwards your petition to the National Visa Center (NVC) located in Portsmouth, New Hampshire to prepare the case for immigrant visa pre-processing. Once your case is received by the National Visa Center, the agency will contact you to collect your visa application, visa fees, and additional supporting documentation known as civil documents. All visa fees and supporting documentation is submitted online via the Consular Electronic Application Center webpage (CEAC).

In this blog post, we summarize some of the most interesting questions that were asked during this live Q&A session with Charlie Oppenheim, including frequently asked questions regarding unused employment-based visa numbers for fiscal year 2021 and the future of family-sponsored categories in the coming months.

Q: Are you concerned with the anticipated large amount of unused fiscal year 2021 employment-based numbers which you mentioned last month?

Charlie Oppenheim responded during the live session that the State Department is very concerned about the potential for unused employment-based numbers under the fiscal year 2021 annual limits. According to Oppenheim, this concern was one of the reasons he made the China and India employment first preference categories current back in April and engaged in very aggressive forward movement of the final action dates since that time to prevent the loss of visa numbers in the employment-based categories. Furthermore, Mr. Oppenheim pointed out that both the State and USCIS offices are doing everything in their power to maximize number use before the end of FY 2021 to avoid drastic losses.

Based on recent discussions with USCIS, Charlie Oppenheim said that the agency is on track to approve more adjustment of status applications than at any time since fiscal year 2005. He also reminded listeners to keep in mind that since March of 2020, both the State Department and USCIS offices, have been dealing with a variety of COVID-19 issues which have had a tremendous negative impact on operational status, staffing, and ability to process large amounts of immigrant visa cases. According to Mr. Oppenheim, overseas posts only began returning to some sense of normal processing in April of 2021.

Q: When I look at the chart listing the final action dates, how do I know if my case is eligible to be scheduled for an interview at the overseas post responsible for processing my case?

This is a very common question that our law office is frequently asked as well. Charlie Oppenheim pointed out that applicants must first ensure that they have submitted all the required civil documents to the National Visa Center to become “documentarily qualified,” meaning that all necessary documents and fees have been submitted to proceed with interview scheduling. Submission of all necessary documents would also need to be done in time for the case to be reported to the Visa Office as documentarily completed by the first of each month. In this case, if you are documentarily qualified and your priority date is earlier than the applicable final action date listed in the Visa Bulletin, then you would be eligible to be scheduled for an appointment for final action on your case. However, even while waiting in line to be scheduled for a visa interview after being “documentarily qualified,” applicants must still take into consideration overseas post processing capacity issues relating to the COVID-19 pandemic. The majority of posts overseas continue to have limited operational capacity; therefore, applicants should expect delays to be scheduled for a visa interview. Overseas posts must first notify the National Visa Center that they have an available slot for an interview before the National Visa Center can forward the case to the post overseas.

Overview

The release of the October 2020 visa bulletin has been much anticipated because the October visa bulletin kicks off the start of a brand-new fiscal year. The October visa bulletin is also important because it provides some insight into the availability of immigrant visa numbers, including visa numbers that have been unused as a result of the Coronavirus pandemic, the suspension of routine visa services at Embassies and Consulates worldwide, and the various presidential proclamations that have halted visa issuance for certain types of immigrants.

As some of you may have noticed, the October visa bulletin was released later than usual, most likely because the Department of State has been scrambling in light of Consular closures to review the data and provide accurate information regarding the number of visas available for each preference category.

Since the suspension of routine visa services at Consular posts worldwide, nearly 100,000 immigrant visa applicants have been unable to obtain their visas, creating a “rollover” of unused visa numbers for the benefit of employment-based preference categories.


Employment Based Categories – October 2020

In order to file for adjustment of status based on employment during the month of October (for applicants lawfully residing in the United States), employment-sponsored applicants must have a priority date that is earlier than the dated listed below for their preference category and country of nationality.

All applicants filing under employment-based preference categories must use the Dates for Filing chart in the Department of State Visa Bulletin for October 2020.

Since Presidential Proclamations 10014 and 10052 have suspended the issuance of immigrant visas for most family-sponsored preference categories, we are seeing a rapid movement in the dates of most employment-based preference categories, because “unused” visas for the family-sponsored categories have shifted or “rolled over” to the employment-based categories as a result of these Proclamations.

Overview


The Healthcare Workforce Resilience Act was introduced by Senators David Perdue (R-GA), Todd Young (R-IN), Dick Durbin (D-IL), and Chris Coons (D-DE) to increase the number of doctors and nurses available to meet the demand of the Coronavirus (COVID-19) pandemic.

While this bill is only a proposal for the time being, it is a great step in the right direction for the future of highly skilled foreign medical professionals. To become law, the bill must be passed by both houses of Congress and signed by the President. The bill is exciting because it is likely to have bipartisan support and has great potential to become law.


Why was the bill passed?


Currently, significant backlogs exist for nurses applying for a green card under the employment-based third preference category (EB-3). As you know Congress has imposed numerical limitations on the number of green cards that can be issued for immigrant workers. For EB-3 there is a waiting period of several years for green cards to become for EB-3 workers, even those with approved I-140 who are prevented from entering the United States because of these numerical limitations. At the moment, the priority date for nurses under EB-3 is stuck around January 2017 which for many nurses means a very long waiting period.

The Health Care Workforce Resilience Act was proposed to alleviate the strain on the U.S. healthcare system. The United States is currently at the epicenter of the Coronavirus pandemic and has an urgent need for doctors and nurses to help flatten the curve.


What does the proposal say?


The bill would authorize USCIS to “recapture” up to 25,000 immigrant visas for nurses and 15,000 immigrant visas for doctors. Additional immigrant visas would also be recaptured for the families of these medical professionals so that principal applicants and their family members can obtain their green cards at the same time.

This recapturing of unused visas in other preference categories would eliminate the backlog for nurses and doctors with approved I-140’s who are seeking an employment-based green card.
