New H-1B rules are changing the immigration landscape for U.S. employers and foreign workers in the United States.

Did you Know? In February of this year, the Department of Homeland Security (DHS) published a final rule in the Federal Register that changed the H-1B registration process and enhanced the H-1B program’s integrity to safeguard against fraud. These changes resulted in a significant drop in the number of eligible H-1B registrations for fiscal year 2025 by 40%.


Overview


The H-1B visa is one of the most popular work visas used by professionals with U.S. job offers to work in specialty occupations. To be eligible for this visa category, applicants must have at least a bachelor’s degree or higher, or the equivalent work experience in the specialty occupation.

Current laws limit the annual number of qualifying foreign workers who may be issued the H-1B visa to 65,000 with an additional 20,000 reserved for the H-1B advanced degree exemption for those with U.S. master’s degrees (or higher). Unfortunately, the high demand for the H-1B visa, makes the lottery process extremely competitive considering that thousands upon thousands of employers compete for the very limited number of visas available every year.

FY 2025 H-1B Registration Period Begins at Noon ET March 6, 2024

The initial registration period for the FY 2025 H-1B cap season will open at noon Eastern on March 6, 2024, and run through noon Eastern on March 22, 2024. During the registration period, prospective petitioners and their representatives, if applicable, must use a USCIS online account to register each beneficiary electronically for the selection process and pay the associated registration fee for each beneficiary ($10 per registration and $215 per registration starting in fiscal year 2026).


Final Rule Brings New Changes to the H-1B Cap Electronic Registration Process


In anticipation of the H-1B cap season, on January 30, 2024, the United States Citizenship, and Immigration Services (USCIS) announced the publication of the final rule, “Improving the H-1B Registration Selection Process and Program Integrity.”

The purpose of the final rule is to strengthen the integrity of the program and reduce the potential for fraud in the H-1B electronic registration process, to prevent beneficiaries or their employers from gaming the electronic registration process to their advantage.

Did You Know? In order to work in the United States, you must apply for the required visa type that allows your temporary employment. You cannot seek employment while on a visitor visa such as a B1/B2 or Electronic System for Travel Authorization (ESTA) under the Visa Waiver Program.

Overview


First, it is important to understand that to work in the United States on a temporary basis, you must apply for the required visa. Foreign nationals cannot enter the United States as visitors with the intention to work in the United States, whether that is on a B1/B2 tourist visa or the Visa Waiver Program. If immigration suspects that you are working without authorization on a visitor visa, you may be barred from re-entering in the future.

Due to the serious consequences that can result from unauthorized employment, it is important to understand which visa types will allow you to work in the United States.

Many nonimmigrant visas allow you to work in the United States for a long duration. One such visa is the H-1B visa program for individuals who will work in a specialty occupation. If selected in the annual lottery, the H-1B visa is valid for 3 years and can be renewed one additional time for a total work period of 6 years. Thereafter H-1B visa applicants can apply for permanent residence based on employment-sponsorship.

Overview: 

At the moment it is quite difficult for foreign nurses to immigrate to the United States because of how strict immigration officials are being in adjudicating these petitions.

While there are rigorous requirements that must be proven to immigrate to the United States, the demand for nurses in the United States continues to grow. Therefore, there is a still a need for foreign nurses to come and work in the United States.

The good news is that the immigration backlog for nurses is decreasing. The time that a nurse must wait to work in the United States depends on the nurse’s country of nationality.

So, how can a nurse get a visa to come to the United States?

There are generally two ways that a foreign nurse can come and work in the United States.

Option 1:

Green Card: A nurse may come to work in the United States if their employer files a petition on their behalf specifically on Form I-140 Immigration Petition for Alien Worker. Once the I-140 is approved, the nurse may apply for an immigrant visa under the EB-3 category for nurses once the I-140 priority date becomes current on the visa bulletin. This process culminates in an interview at the U.S. Consulate for the immigrant visa.

Option 2:

H-1B: A foreign nurse who has a Master’s or Bachelor’s degree, plus five years working experience, and is seeking to work in a specialty occupation (for example as managers or nurse practitioners) may apply for the H-1B work visa.

Option 3:

TN Visa: A foreign nurse from Canada or Mexico may apply for a TN visa.

Most nurses come to the United States by being petitioned for a green card directly by their employer.

What is required for this option?

  • The foreign nurse must have a visa screen which is an evaluation of educational equivalency by the CGFNS (Commission on Graduates of Foreign Nursing Schools)
  • The foreign nurse must establish English proficiency by passing either the Test of English as a Foreign Language (TOEFL) www.toefl.com or International English Language Testing System (IELTS, academic version) www.ielts.org.
  • The foreign nurse must also pass the state licensing exam and the NCLEX (National Council Licensure Examination)
  • The foreign nurse must have a job offer and
  • The employer must be willing to sponsor the foreign nurse for permanent residency
  • The employer must be willing to pay the prevailing wage of the location where the foreign nurse will be working

The J-1 is a very popular visa that is administered by the State Department, not USCIS.

How does it work and who qualifies for the J-1 Cultural Exchange Visa?

The J-1 visa allows individuals such as students and trainees to come to the United States to receive practical training or participate in an internship program, to gain experience in a particular field of study, and take that experience and skill set back to the country of origin. The practical training or internship program should be one that is not available in the individual’s country of origin. The J-1 cultural exchange visa program allows the foreign national to obtain experience that they would not have otherwise obtained in their home country.

The J-1 visa requires a third-party sponsor that controls and supervises the J-1 program that the foreign national will participate in, while the State Department administers the filing process of the J-1 visa. The third-party sponsor also ensures that the foreign national will return to their country of origin at the conclusion of the cultural exchange program.

What types of training programs can foreign nationals participate in with this visa type?

Foreign nationals may participate in the J-1 cultural exchange visa program as au pairs, scholars, researchers, trainees, and professionals.
