FY 2025 H-1B Registration Period Begins at Noon ET March 6, 2024

The initial registration period for the FY 2025 H-1B cap season will open at noon Eastern on March 6, 2024, and run through noon Eastern on March 22, 2024. During the registration period, prospective petitioners and their representatives, if applicable, must use a USCIS online account to register each beneficiary electronically for the selection process and pay the associated registration fee for each beneficiary ($10 per registration and $215 per registration starting in fiscal year 2026).


Final Rule Brings New Changes to the H-1B Cap Electronic Registration Process


In anticipation of the H-1B cap season, on January 30, 2024, the United States Citizenship, and Immigration Services (USCIS) announced the publication of the final rule, “Improving the H-1B Registration Selection Process and Program Integrity.”

The purpose of the final rule is to strengthen the integrity of the program and reduce the potential for fraud in the H-1B electronic registration process, to prevent beneficiaries or their employers from gaming the electronic registration process to their advantage.

Overview


What do the famous international DJs Avicii, Tiesto, David Guetta, Calvin Harris, and Afrojack have in common? They are not American, or at least they were not American, when they first entered the United States. These individuals had to apply for a special visa type, enabling them to perform in the United States, known as the O-1B visa of extraordinary ability in the arts.

Recently, our firm represented an internationally recognized DJ similarly performing under the Electronic Dance Music (EDM) genre.


O-1B Extraordinary Ability in the Arts Requirements


To work in the United States as a DJ, you must apply for the O-1B extraordinary ability in the arts visa type.

The O-1B visa is available to DJs who have extraordinary skills and can meet the O-1B criteria of national or international recognition.


What do DJs need to qualify for the O-1B visa?


Before you consider the O-1B visa, it is necessary for you to be represented by a U.S. employer, U.S. agent, or a foreign employer through a U.S. agent, who can file the O-1B petition on your behalf as your “petitioner.” In general, an applicant demonstrates his or her extraordinary ability in the O-1B category by providing evidence of sustained national or international acclaim, showing recognition of achievements, and providing signed contracts, offer letters, deal memos, letters of intent, and/or a detailed itinerary outlining the details of each planned performance.

Did you know? Individuals can self-petition for the EB-1A visa category. No employment sponsorship or labor certification is needed. If your EB-1A visa petition is approved by the U.S. Citizenship and Immigration Services (USCIS), you are eligible to apply for a green card by filing Form I-485, Application to Register Permanent Residence (if legally residing in the United States) or through Consular processing (if you are residing abroad). You may include your dependent family members on your I-485 application.

Overview


The EB-1A is an employment-based visa type for individuals who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international recognition in their field. To qualify, individuals must meet at least 3 of the following 10 criteria or provide evidence of a one-time achievement such as a Pulitzer Prize, Oscar, or Olympic Medal. EB-1A applicants must also be prepared to provide evidence that they will continue to work in their area of expertise in the United States once approved.

The main benefit of the EB-1A is that you can self-petition. You do not need sponsorship from a U.S. employer or labor certification to apply. As you might recall, earlier this year, USCIS issued a news alert encouraging employment-based applicants to consider transferring the underlying basis of their adjustment of status application to EB-1A or EB-2 if eligible, because of the exceptionally high number of employment-based immigrant visas available in those categories.

The USCIS Backlogs

In this video we talk about the latest statistics with respect to USCIS backlogs and case delays impacting many of the people watching our videos. As you know, the Coronavirus pandemic has severely impacted the processing times of USCIS petitions with many service centers facing unprecedented delays. As time goes on, we expect the USCIS backlogs to continue to grow. It is estimated that the agency will take at least a year to catch up to current demand.

According to an August 2021 government accountability report, it is estimated that the number of cases pending adjudication at USCIS grew by over 81% since fiscal year 2015.

Looking at the second quarter of fiscal year 2020, USCIS had a backlog of approximately 3 million cases which swelled to 5.8 million cases by fiscal year 2021.

Essentially, the report indicates that USCIS processing delays have continued to grow since fiscal year 2017, increasing by approximately 50% in fiscal year 2021. This has happened despite only a slight 3.6% increase in cases received annually by USCIS. Over the last fiscal year alone (FY 2020 to 2021), there was about an 11% increase in USCIS processing times.

This information is crucial to understand the reasons behind the current USCIS backlogs caused partially by the COVID-19 pandemic, the inefficiencies on the part of USCIS, budgeting issues, and other contributing factors. The fact is, USCIS is facing a crisis.


So, what are the main types of applications being impacted by the backlogs?


According to the report, certain “high volume” forms filed with USCIS have been disproportionately impacted.

These include Form I-730 Refugee/Asylee petitions, that are now facing processing time increases of 20 months when compared to 12.4 months in fiscal year 2019.

Form I-485 green card applications also increased to 12.9 months when compared to 10.9 months in fiscal year 2019.

Similarly, N-400 application processing times increased to 11.5 months when compared to 10 months in fiscal year 2019.

Form I-130 petitions for alien relative increased to 10.2 months when compared to 8.6 months in fiscal year 2019.

Finally, processing times for Form I-140 immigrant petitions for alien workers increased to 8.2 months when compared to 5.8 months in fiscal year 2019.

The United States Citizenship and Immigration Services (USCIS) has submitted for federal review, a final regulation that if passed would expand premium processing services to additional categories of immigrants. The rule is currently under review at the Office of Management and Budget (OMB). While the rule has not yet been published in the Federal Register, it has the potential to substantially improve processing times for more categories of immigrants that have been waiting extended periods of time for their applications to be approved during the COVID-19 pandemic.

Overview


Many have been eagerly awaiting news regarding the expansion of premium processing services and it seems the time has almost come. For those who may be wondering, premium processing service is a special type of fee-based service offered by USCIS that allows for expedited processing of certain Form I-129, Petitions for Nonimmigrant Worker, and Form I-140, Immigrant Petitions for Alien Worker. With this service, applicants can pay an additional fee and submit Form I-907, Request for Premium Processing Service, to guarantee the adjudication of their applications within 15 calendar days.

The current categories of applicants who can request premium processing service and the required filing fees are as follows:

  • $2,500 if you are filing Form I-129 requesting E-1, E-2, E-3, H-1B, H-3, L (including blanket L-1), O, P, Q, or TN nonimmigrant classification.
  • $1,500 if you are filing Form I-129 requesting H-2B or R nonimmigrant classification.
  • $2,500 if you are filing Form I-140 requesting EB-1, EB-2, or EB-3 immigrant visa classification.

Outside of the above categories of visa applicants, premium processing service has not been made available to other applicants. But this may all be about to change.

While we are still awaiting the rule’s official publication in the Federal Register to study its complete details, we know that the rule will identify additional categories of applicants who can request premium processing service and will provide in detail the processing times, and associated fees for each type of applicant.

Updates from the AILA Conference

Today, the United States Citizenship and Immigration Services (USCIS) announced that effective today, applicants with pending U visa applications, or those who are getting ready to file new U visa applications, are eligible to apply for employment authorization by filing Form I-765 Application for Employment Authorization and can receive “deferred action” status meaning that they will not be prioritized for removal from the United States.

For those who are not familiar with the U visa program, the U visa is a special immigrant status given to victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity. Among those eligible are certain victims of abduction, domestic violence, sexual assault, trafficking of noncitizens, rape, prostitution, and other crimes, who are willing to help law enforcement authorities in the investigation or prosecution of the criminal activity. The U visa eventually allows the victim to attain lawful permanent residence in the United States (also known as the green card).

Previously U visa beneficiaries were not entitled to employment authorization, making their lives extremely difficult considering that it is currently taking over 5 years to process the U visa application.

With this new policy change, those who have filed a U visa application that has been pending with USCIS, will be eligible to apply for employment authorization as of today, as well as new applicants.

Overview


As you know, on March 20, 2020, USCIS temporarily suspended premium processing services for all Form I-129 and I-140 petitions due to the Coronavirus. Petitioners who submitted a premium processing request in connection with Form I-129 or Form I-140, before the March 20 suspension, but received no action and no refund, may refile Form I-907 in keeping with the timeline discussed below.


How will premium processing services resume?


Premium processing will resume in a multi-phased approach.

First, effective June 1, 2020, USCIS will accept premium processing requests for all eligible Form I-140 petitions.

Second, effective June 8, 2020, USCIS will accept premium processing requests for:

  • H-1B petitions filed before June 8 that are pending adjudication and are cap-exempt (for example, petitions filed by petitioners that are cap-exempt and petitions filed for beneficiaries previously counted toward the numerical allocations).
  • All other Form I-129 petitions (non H-1B petitions) for nonimmigrant classifications eligible for premium processing filed before June 8 that are pending adjudication.

RFE/NOID Policy

Beginning September 11, if you do not provide sufficient evidence to establish that you are eligible for the immigration benefit you are requesting, USCIS may exercise their discretion and deny your petition without first issuing a request for evidence or RFE. This new policy applies to all applications and petitions filed after September 11th, with the exception of DACA renewal applications.  The decision to deny your application or petition without issuing a RFE or NOID will ultimately be up to the discretion of the officer reviewing your petition. An officer may in his discretion continue to issue a RFE or NOID according to his best judgement.

If you are filing for a change of status or extension of your status, we recommend that you file early, so that you are not out of status in the case that USCIS denies your request for an immigration benefit. This will give you the opportunity to either re-file or to consider changing your status to another visa type. In addition, if you have the ability to apply for premium processing service, you should take advantage of that service.

Suspension of Premium Processing

At the moment premium processing services have been temporary suspended for cap-subject petitions until February 19, 2019, with the exception of cap-exempt petitions filed exclusively at the California Service Center, because the employer is cap-exempt or because the beneficiary will be employed at a qualifying cap exempt institution.
